STUDIO MOHAR TERMS & CONDITIONS

By placing an order with Studio Mohar, you agree to these Terms and Conditions. Read them carefully.
1. ORDERING & QUOTES
Quote Approval Required All quotes must be approved in writing (email confirmation) before production begins. Submitting payment constitutes approval and authorization to begin production.
Order Acceptance We reserve the right to refuse or cancel any order at our discretion, including orders that contain artwork we believe may infringe intellectual property rights, contains pixelated artwork, contain offensive content, or violate these terms.
Pricing Prices are confirmed at the time of quote approval. We reserve the right to correct pricing errors and will notify you before proceeding with production.
No Minimums We don't require minimum order quantities. Order 5 pieces or 500, same quality, same terms.
2. ARTWORK, DESIGN & INTELLECTUAL PROPERTY
Ownership You retain full ownership of all artwork and designs you submit to us. By submitting artwork for printing, you grant Studio Mohar a non-exclusive, royalty-free license to reproduce, print, and process your artwork solely for the purpose of fulfilling your order.
Your Warranties By submitting artwork, you represent and warrant that:
- You own all rights to the artwork, OR you have obtained all necessary permissions and licenses to use the artwork for printing purposes
- The artwork does not infringe on any third-party intellectual property rights, including copyright, trademark, trade dress, patent, or design rights
- You have the legal authority to grant us permission to print this artwork
Copyright & Trademark Indemnification You agree to indemnify, defend, and hold harmless Studio Mohar, its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees and court costs) arising from or related to:
- Any claim that your submitted artwork infringes or violates any intellectual property rights of any third party
- Your breach of the warranties stated above
- Any legal action taken against Studio Mohar related to the artwork you provided
Our Position Studio Mohar does not verify, investigate, or guarantee the intellectual property rights of artwork submitted by customers. We are not responsible for determining whether your artwork infringes on third-party rights. If you are unsure whether you have the rights to print specific artwork (logos, characters, images, brand names), consult with a legal professional before submitting your order.
We Will Refuse We reserve the right to refuse orders containing:
- Obvious trademark or copyright infringement (Disney characters, sports team logos, brand names, etc.)
- Offensive, discriminatory, or hateful content
- Content that violates applicable laws
3. PROOF APPROVAL & CUSTOMER RESPONSIBILITY
Digital Proofs We provide digital proofs for your approval before production. It is your responsibility to carefully review all proofs for:
- Spelling and grammar errors
- Design accuracy and placement
- Color representation
- Size and positioning
Approval Means Go Once you approve a proof (via email confirmation or payment), production begins. We are not liable for any errors that were present in the approved proof, including spelling mistakes, design errors, incorrect colors, or placement issues.
Post-Approval Changes Changes requested after proof approval may result in additional charges and extended production timelines.
Color Matching All colors are matched to the closest available ink in our inventory. For exact color matches, request Pantone matching at the time of quote - additional charges may apply. Screen colors are approximations; final printed colors may vary slightly from what appears on your monitor.
4. PRODUCTION & TIMELINES
Standard Production Standard production time is 7-10 business days from the date of proof approval and full payment, not from the date of initial inquiry or quote request. Bulk orders can naturally take more time than the standard times quoted above.
Rush Production Rush orders (3-5 business days) are available for an additional fee. Contact us before placing your order to confirm rush availability.
Delays Beyond Our Control We are not liable for production delays caused by:
- Supplier or manufacturer delays, out-of-stock items, or discontinued products
- Shipping carrier delays
- Acts of God, natural disasters, pandemics, or other force majeure events
If delays occur, we will notify you immediately and provide alternative options or updated timelines.
Product Substitutions If your selected garment style, color, or size becomes unavailable, we will contact you with comparable alternatives. You may approve the substitute or cancel your order for a full refund.
Wait & Save option is available for orders containing any single item with quanitity over 50 pieces. With this option the timeline for production can be 25-40 days.
5. QUALITY CONTROL & SPOILAGE
Our Standards We maintain high quality control standards and inspect all orders before delivery.
Acceptable Spoilage For orders over 144 pieces: up to 2% spoilage is considered acceptable industry standard. For orders under 144 pieces: up to 5% spoilage is considered acceptable industry standard.
Spoilage refers to minor defects in blank garments (small fabric imperfections, slight color variations within the same dye lot) or printing variances within acceptable tolerances.
Exact Quantities If you require an exact quantity (e.g., 50 pieces for a team of exactly 50 people), we recommend ordering 5-10% extra to account for potential spoilage or sizing exchanges.
6. RETURNS, REFUNDS & DEFECTS
Custom Products Are Non-Refundable All custom printed apparel is made to order and cannot be returned or refunded except in cases of production defects or errors on our part.
Defects & Misprints If you receive defective or misprinted items due to our error (not errors in customer-approved proofs), you must notify us within 72 hours of receiving your order. Defective items may include:
- Printing defects (smudging, incomplete transfers, color errors not matching approved proof)
- Defective blank garments (stains, tears, manufacturing defects)
Return Process Contact us immediately with photos of the defective items. If approved, defective items must be returned within 1 business week. We will reproduce the order to correct specifications or issue a refund at our discretion.
What We Don't Cover We are not responsible for:
- Errors present in customer-approved proofs
- Defects in customer-supplied garments or materials
- Normal wear and tear after use
- Damage from improper care or washing
- Dissatisfaction with color if proof was approved
- Issues reported after the 72-hour window
7. CANCELLATIONS & ORDER CHANGES
Cancellation Policy Order cancellations must be submitted in writing (email) and are subject to fees for any work already completed, including:
- Design and artwork processing
- Blank garments already ordered
- Printing setup and materials
- Any production work completed
Refund amount depends on the stage of production at the time of cancellation request.
No Cancellations After Production Starts Once production has begun (printing/pressing in progress), orders cannot be cancelled.
8. PAYMENT TERMS
Payment Due Full payment is required before production begins unless net payment terms have been pre-arranged in writing.
Payment Methods We accept credit card, debit card, e-transfer, cheques, and EFT. Credit card processing is handled through secure payment processors.
Late Payments For customers with approved net payment terms: orders may be held or future orders refused for late payments.
9. LIMITATION OF LIABILITY
Maximum Liability To the maximum extent permitted by law, Studio Mohar's total liability for any claim arising from or related to your order shall not exceed the total amount you paid for that specific order.
No Consequential Damages We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Lost profits or revenue
- Loss of business opportunity
- Event cancellations or delays
- Reputational damage
- Any damages beyond the order value
No Warranties Beyond Stated Terms We make no warranties, express or implied, beyond those explicitly stated in these terms, including implied warranties of merchantability or fitness for a particular purpose.
10. MARKETING & PROMOTIONAL USE
Use of Your Order for Marketing Studio Mohar may use images and details of your order for marketing and promotional purposes, including:
- Photos of completed products
- Design mockups
- Artwork and graphics from your order
- Display on our website, social media, portfolio, or marketing materials
Opt-Out If you do not want your order used for marketing purposes, email us at design@studiomohar.ca before or immediately after placing your order. We will mark your order as excluded from promotional use.
No Compensation By placing an order, you grant Studio Mohar a non-exclusive, royalty-free license to use photos and details of your order for marketing purposes. No compensation will be provided for this use.
11. GENERAL TERMS
Modification of Terms We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted with a new effective date. Continued use of our services after changes constitutes acceptance.
Governing Law These terms are governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.
Entire Agreement These Terms and Conditions constitute the entire agreement between you and Studio Mohar regarding your order and supersede any prior agreements or understandings.
By placing an order with Studio Mohar, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
